Legislation Pertaining to Professional Nursing Practice:

NYSASN Supports the Following Legislation:

  • A00553: Relates to the employment of school nurses for the inspection of pupils attending certain public schools; relates to school districts and boards of cooperative educational services.
  • A04926: Requires a school nurse to be on the premises during school hours in any school having an enrollment of 100 pupils or more.
  • A00359: Relates to when school personnel may adjust a student’s dosage of insulin: under instructions from the prescriber or instructions from the parent or person in parental relationship where explicitly authorized by the prescriber.

Legislation Pertaining to Student Health and Safety:

NYSASN Supports the Following Legislation:

  • A2371: Repeals provisions relating to exemption from vaccination due to religious beliefs.
    Update: Signed into Law by Governor Cuomo on June 13, 2019.
  • A1135: Provides that persons in parental relation to a child refusing to immunize such child for religious reasons, shall file with the school an affidavit signed by a physician, stating that such physician has explained to the parent, parents or guardian the risks to the child and to other individuals of failure to immunize the child.
  • A2316: Relates to mandatory influenza vaccine for persons attending daycare.
  • S0298: Provides for the immunization of all children born after January 1, 2008 with the human papillomavirus (HPV).

NYSASN Supports the Following Student and School Safety Legislation:

  • A4484: Relates to classroom safety mechanisms, emergency medical equipment, and evidence-based best practices for school safety planning and training.
  • A4876: Establishes the “Dominic Murray sudden cardiac arrest prevention act”; directs the commissioners of education and health to establish rules and regulations for the treatment and monitoring of students of school districts, boards of cooperative educational services and nonpublic schools who exhibit signs or symptoms of sudden cardiac arrest.
  • S1297: Directs promulgation of rules and regulations concerning removal of ticks from pupils and notification to parents.

NYSASN Opposes the Following Religious and Medical Exemption Legislation:

  • S3424: Creates a statewide, uniform religious belief exemption form to be available in all schools.
  • S0477: Extends the protections of the medical exemption from mandatory immunizations for students to ensure deference to the professional assessments of physicians, nurse practitioners and physician assistants in the care of their individual patients.
